No. 38450.Supreme Court of Nevada.
April 3, 2002.
ORDER OF REINSTATEMENT BEFORE: MAUPIN, C.J., YOUNG, J., SHEARING, J., ROSE, J., LEAVITT, J., BECKER, J.
This is a petition for reinstatement from disability inactive status by attorney Gordon Logan. We referred this matter to the Northern Nevada Disciplinary Board for a hearing on whether Logan’s disability has been removed so that he is fit to resume the practice of law.[1] The hearing panel found that Logan’s disability has been removed, and that he is fit to practice law, subject to several conditions designed to ensure that Logan continues to receive treatment for his condition and to ease his transition back to practice. Specifically, the conditions are: (1) Logan shall submit to random drug testing upon 12 hours notice by bar counsel for the first two years of his reinstatement; (2) he shall continue to attend AA meetings at least twice a week for so long as he is engaged in the active practice of law; (3) in the event he establishes a solo practice, he shall obtain a mentor to be approved by bar counsel and a member of Lawyers Concerned for Lawyers; (4) he shall continue counseling with Dr. Turner until such time as Dr. Turner recommends discharge of alternative treatment; (5) he must complete 10 hours of CLE, in addition to the 12 hours required of all Nevada lawyers; (6) he must file semi-annual reports with bar counsel containing a summary of his compliance with the conditions, and shall provide proof of attendance at AA meetings; in addition, if he is in solo practice, the mentor shall also submit a semi-annual report; (7) he must pay the costs of the reinstatement proceeding within one year of reinstatement; and (8) these conditions are to remain in effect until such time as Logan petitions the state bar for relief.
We conclude that clear and convincing evidence supports the panel’s findings, and that the conditions recommended by the panel are appropriate. Accordingly, Logan is reinstated to the practice of law, subject to the conditions recommended by the panel.
It is so ORDERED.[2]
